What is Proposition 65?
Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, is a California “right-to-know” law. It requires businesses to provide warnings about potential exposure to certain chemicals that the State of California has determined may cause cancer, birth defects, or other reproductive harm. The state maintains a list of over 900 such chemicals.
Any business that sells products in California—whether located in the state or not—must provide a “clear and reasonable” warning if their products could result in exposure to a listed chemical above safe threshold levels. These warnings must be provided before purchase and before the consumer is exposed.
